Dad gave me car to use, then cancelled the insurance
Please help - I need advice.
My father, who lives out of state, gave me one of his cars to use while I was in college. The car was licensed and registered to him and insured by him. He always sent me the insurance card to keep on me. I was involved in an accident - (other person's insurance company took 100% liability - driver was underage driving illegally.) I presented police officer with insurance card which was in date and to the best of my knowledge valid. I had no reason to think otherwise. It wasn't until I called the insurance company to report the accident that day that I found out my father had dropped the insurance on the car I was using just a week before, to add a new car he had purchased. The car was totalled and my father received payment in full for the car. The problem is that NYS is suspending my drivers license for a full year for driving without insurance. As I am a victim in this case, twice over, please let me know if there is any action I can take to appeal this suspension and what would be the best way to go about it. Were you convicted of an offense in relation to the insurance? If so, what was the charge - and was it a civil infraction or criminal charge?
