Raising premiums after a non fault accident in California

Hello,

I was in an accident in October 2004...hit from behind on the freeway during rush hour traffic. My car was totalled...it was 100% the other parties fault...however he only had the bare minimum insurance...which has since been paid out. My attorney is going after my insurance company for my underinsured motorist coverage...I had excellent coverage atthe time of the accident.

I went out of the country and so my vehicle has not been insured for some time(more than 6 months). I am now shopping around for the best deal...and I have found that the insurance companies(in particular my old insurer) are blatently charging more with the accident on record...irregardless of the fact that I had no fault. I was under the understanding,and my attorney advised me this is not legal. I went through the online quote system twice...once putting the not at fault accident on the record and then again without. The premium is almost double, with the accident on record....what can I do about this?
