Financial Channel

I was rear ended at a stop light while at a complete stop. The driver of the vehicle was not the owner or insured and was on a cell phone when she struck my truck resulting in over $1100 damage. An adjuster did come out and still has not given me an estimate either. The current estimate I had to take and get on my own. The other car is insured by the same national company I also have my insurance with (SF) in florida. The car owner himself exchanged information with me and I turned it in. The company is now telling me the actual person who is listed as the insured passed away and I am having difficulty recouping the funds. Although the other vehicle was still under policy the day of the accident. They now want me to pay for the repairs myself. Not sure if this is a loop hole for them to get out of it or what steps to take from here since both vehicles insured by same company? Thank you in advance.

Did the owner pass away before or after the accident?

They havent stated as to when he passed. They tell me now it's a question as to if the driver had the "decease's" permission to drive and how to prove that they did. So I'm still waiting at this point. I only have PIP/No fault for my own policy as full coverage would cost me more per year then the value of the vehicle. I had it changed when I wasnt driving due to several military deployments. Just seems several months of waiting is too long.

Sound's like you need to file a small claims case and a claim in probate court against the estate. This is probably the only way to go. State Farm will not pay if there is any way possible to wiggle out of it based on my personal experience with them.

You also would have a claim against the estate of the deceased person in the event there was no permissive use. You need to contact the court and submit a claim before the estate is probated. Do this quickly.
