Friend backed her car into mine in my driveway while I was sitting in the passenger seat of her car. I knew she didnt have very much money so since we were friends I let her have a break for a month. The wreck happened on the 29th of June I got a estimate on the 26th of August. I call her up and she no longer wishes to give her insurance info out of fear of raising rates and that she will pay me in monthly payments under the counter, I have given her plenty of time to offer her auto insurance info and yet everytime she refuses. What legal action must I take to get this info from her?

You can sue her in small claims court.

If she will not give it over voluntarily it appears legal action is your only recourse. Maybe she does not actually have insurance. Though it may be fruitless at this point you may see if the police would do an accident report now for you and they normally get information about the respective parties' insurance or lack thereof. If she didn't have it at that time then technically she could be cited for no proof of liability insurance (assuming it is required in your state).

Barring that you may have to sue to her in civil court--I've had to do that for clients where we could not obtain insurance information, especially when we were trying to determine policy limits. You would obtain the policy through the process of discovery.

She was insured the time of the accident. Unknown if she is insured currently. Is there any way that this accident occuring over a month ago will have problems with the auto insruance companys and getting a claim started?
