Hi to everyone!
I know theres a lot of helpfull people here.Please help me naman!My situation is i am newly wed .I have 3 kids in the Philippines (9,8 and 4 yrs old).Di ako kasal sa tatay ng mga anak ko but nasa apelyido ng tatay .My Japanese husband want them to be adopted.What am i supposed to do about there birth certificate?Then the next step...and so on?Sa mga mag-rereply maraming maraming salamat sa inyo...

I am not a lawyer but as far as I know, the mother gets custody of the children if the parents are unmarried and the illegitimate children shall bear the last name of the mother. This is an exerpt from the Family Code of the Philippines:

Art. 176. Illegitimate children shall use the surname and shall be under the parental authority of their mother, and shall be entitled to support in conformity with this Code. The legitime of each illegitimate child shall consist of one-half of the legitime of a legitimate child. Except for this modification, all other provisions in the Civil Code governing successional rights shall remain in force. (287a)
